Are red light camera/photo tickets disputable?
I received a red light violation citation in San Francisco, CA detected by a photo camera, although I honestly do not recall running any red lights. In fact, I've been driving in San Francisco for 10 years and never received a ticket before. The ticket says the yellow was on for 3.1 sec prior to red, and red was on for 0.3 sec when I entered the intersection. Can I dispute such sitation?
I remember reading some articles about people who beat photo-radar tickets. It seems the best defenses were those that challenged the manufacturer of the ticket machines - if they contracted with the city and were paid on a per-ticket basis (instead of a flat monthly rate), then that would reason to dismiss the ticket.
A machine-based traffic enforcement system could not be used on a commission-basis between the city and mfr.
But I don't know how San Francisco manages their photo-radar units. If they bought them outright, you will have a hard time winning that case.
The other strategy is to challenge the technical capability of the machine. What is its calibration schedule, and what does the data look like? If the radar, timing and connections with the traffic light are suspect, I think you could win.
Those are my thoughts. I think you need to hire a lawyer who has defended and won these cases before.
Good luck, and tell us what you do and if you win or lose.
